In today’s modern world filled with technological wonder and a focus on the preservation of life, longevity and individual health, medical malpractice would seem to be one the least expected things that comes up in the court of law. Unfortunately, this happens more often than not. Family chose hospital facilities and doctors to care for the newest addition, trusting in the years of experience and dedication that the institution has to offer. Almost never do they expect the worst of things to happen.

From time to time, families find that their child has unfairly been put at risk due to negligence of the hospital staff. In the worst cases, the child suffers irreparable damage as a result. Recently, a 4.3 million Euro settlement was made between and family and a primary care hospital. Though the primary care hospital denied negligence, the family blamed the “substandard” management of his birth for the serious brain-damage the child sustained while in the hospital.

Many people felt that 4.3 million Euros was an outrageous number, but was that truly the case? Recent studies have shown that the financial burden incurred by the family of a severely brain-injured individual exceeds several hundreds of thousands of dollars each year in just medical expenses. This figure does not include the time and wages lost caring for that individual and any other extra accommodations that need to be made as a result.

On top of these expenses, there are several other things that need to be considered that don’t have a monetary value at all. These things include the pain and suffering of the family and the psychological effects that a severe birth injury may have on the child.

Another example of negligence is the accidental overdose of heparin that was administered to the mother and twin infants not long after birth. The potency of the drug was given at 1,000 times the intend dosage! It is precisely this kind of negligence that needs to be rectified by the legal system. And when an institution has to pay several million dollars to correct a mistake, the chance is unlikely that they will commit that mistake once more.

It is always important to check up on the hospital before you decide to entrust your babies life to them. Meet with the faculty; see if they have a level 3, neonatal intensive care unit; ask questions. Do they have ’round-the-clock pediatric and neonatology care on-site? How do you feel about their support team? These are important questions to learn about the place that will bring your new family into the world.

For most parents, the birth of a child is an exciting and joyous experience. But nowadays, 3 to 4 percent of newborns suffer from birth-related injuries. In the United States, cerebral palsy has become a serious birth-related injury which affects 5,000 to 10,000 infants each year.

There are different types of birth-related injuries that may happen before, during, or after the birth of a child. Although there are several types of birth injuries, one of the most popular and common type of birth injury is cerebral palsy.

Rather than a disease, cerebral palsy in newborn babies is a physical condition that is caused by brain damage before, during, or after birth. There are four different types of cerebral palsy: spastic cerebral palsy, ataxic cerebral palsy, athetoid cerebral palsy, and mixed cerebral palsy. Each type of cerebral palsy has its own characteristics. Of the four types of cerebral palsy, spastic cerebral palsy is the most common type. It accounts for eighty percent of all cases today in the United States.

Birth injury-related cerebral palsy is usually caused by birth asphyxia (lack of oxygen during the birth process), a complex condition which is difficult to predict or prevent.

Premature birth, low birth weight, hemorrhage in the child’s brain, an infection or illness in the mother like rubella, toxoplasmosis; intrauterine exposure to drugs or alcohol are other reasons for birth injury related cerebral palsy.

Even though doctors and nurses are trained to identify symptoms of cerebral palsy, in most cases they fail to recognize the problem of brain injury in newborn babies. This failure may lead to birth injury related cerebral palsy. When cerebral palsy is caused due to birth injury (negligence), it becomes a case of medical malpractice .The parents of victims can claim for compensation for life long care. With the help of a cerebral palsy lawyer, victims can easily win compensation for medical malpractice.

The months that precede the birth of a child are filled with preparation and planning for the expecting parents. Expecting mothers often take great pains to make sure they are as healthy as possible, and that their child is healthy through the duration of the pregnancy. Unfortunately, all of the precautions that are taken before birth can be undone by errors made by medical professionals during childbirth.

Injuries to babies and mothers during childbirth may occur for a variety of reasons. The chances of birth injury increase dramatically during “high-risk” pregnancies, which usually feature additional risks than the traditional pregnancy. High risk pregnancies may include:

• Gestational diabetes

• Anemia

• Pre-term labor

• Fetal infection

• Maternal infection

• Placental abruption

• Pregnancy-induced hypertension

Proper pre-natal care and frequent check-ups are often instrumental in preventing injuries in high-risk pregnancies. Women who may be at a higher risk for complications may include:

• Advanced age

• Pre-existing medical conditions like high blood-pressure or diabetes

• Complications with previous pregnancies

Women who find themselves at a higher-risk of complications should take extra precautions to avoid serious injury to themselves and their child. It is recommended that they maintain a healthy diet, consider taking folic acid supplements, and should make regular pre-natal appointments with a trusted medical professional.

Naturally, women with high-risk of complications during birth should avoid drinking alcoholic beverages, cigarettes, and drug use. It is recommended that expecting mothers take all necessary precautions to avoid complications during childbirth. It is important to note that any pregnancy can become high-risk, and mothers who notice signs that something may be wrong should consult their physician immediately.

Unfortunately, the best laid plans may result in disaster if the medical professionals attending the childbirth do not exercise care during the procedures. This includes recognizing and handling any complications that may arise during the birthing process. Doctors and nurses should take pains to ensure proper handling of the child during birth and should avoid injuring the mother and child at any cost.

If a mother and/or child are injured due to negligence on the part of doctors or nurses, they may be eligible for compensation for their pain and suffering.

There are three types of cerebral palsy. Spastic cerebral palsy means a person can not relax their muscles or their muscles are permanently stiff. Athetoid cerebral palsy means that the patient can not control the movement of their muscles and may regularly suffer from involuntary movements of the affected areas. Ataxic cerebral palsy means the patient will struggle with balance and coordination. Cerebral palsy can differ in it’s severity from mild to very severe. Very severe cerebral palsy will usually necessitate the use of a wheelchair and the parts of the brain that control speech and other functions may be effected.

1- An Orthopedist can help alleviate some of the problems and may be able to slow down problems that are associated with cerebral palsy. The orthopedist will be able to tell you any physical exercises or other forms of treatment that may be required and your doctor should instantly refer you to an orthopedist for further help.

2- There are no tests that can determine whether or not a child has cerebral palsy although doctors will use x-rays and other scans and tests to help determine the extent and severity of the disease. Doctors are very good at diagnosing cerebral palsy and also at explaining what is required to the patient’s parents.

3- It is not always immediately obvious if a child has cerebral palsy and it may only surface when the child is around 18 months old and trying to sit or crawl. Most cases should be diagnosed by the time the child gets any older than this.

4- There is no cure for cerebral palsy but the patient will be given medication to help control seizures or spasms. Conversely, the cerebral palsy itself will not get any worse. If a child is born with cerebral palsy that affects the legs they will not develop cerebral palsy in the arms as well. However, the legs themselves will deteriorate over time and other conditions may develop. This is why it is vitally important to get the appropriate therapy as soon as possible.

5- Cerebral palsy does not ordinarily stop children from attending school and leading normal lives for the main part. Obviously, there will be some activities that they won’t be able to take part in. It will take a good level of understanding from staff and students alike to give children with cerebral palsy the extra time they need to speak or get around. A child with cerebral palsy knows what they want to say it just takes a little longer and they should be given the opportunity to finish sentences themselves.

Caesarean sections, also called c-sections or spelled cesarean sections, is a form of childbirth. In this type of childbirth, a surgical incision is made through a mother’s abdomen and uterus to deliver the baby or babies. This procedure, historically, has been performed when a normal, vaginal delivery would put either the baby’s or the mother’s life or health at risk. Recently, it has become more requested by people for births that would otherwise have been normal.

Not all caesarean sections are the same as there are several different types. The main differences are related to the deep incision made on the uterus, below the skin and subcutaneous tissue. They should be differentiated from the skin incision, such as a pfannenstiel incision.

A classical caesarean section uses a midline longitudinal incision. The placement of the incision allows for a large space to deliver the baby. Unfortunately, this type is rarely performed today because it frequently results in complications.

A lower uterine segment section is the type of c-section most frequently used in hospitals and clinics today. This type of c-section uses a transverse cut just above the bladder. It is more frequently used because it results in less blood loss and is easier to repair.

An emergency c-section is performed after labor has started. Crash c-sections are performed when there is some sort of emergency. These can be complications of pregnancy which onset suddenly during labor. They are most frequently used when swift action is necessary to prevent the deaths of the mother, child(ren), or both.

A caesarean hysterectomy consists of a caesarean section which is followed by a hysterectomy. This type of c-section can be performed in cases of bleeding which cannot be stopped or when the placenta cannot be separated from the uterus.

There have been other types of c-sections used historically. In many hospitals now, particularly in Argentina, the United Kingdom, the United States, Canada, Australia, Norway, and New Zealand, the woman’s birth partner is encouraged to attend the surgery to support the mother and share the experience.

As with any surgery, there are risks involved to all involved. A c-section is particularly dangerous when it is an emergency c-section. This is because something has occurred that has caused the surgeons attending the birth to feel the need to remove the baby surgically.

The birth of a child is a day that every parent remembers for the rest of his or her life. They are also placing an extreme amount of trust in the hands of the medical professionals who handle the birthing process. When something goes wrong and mistakes are made, the results can be devastating, as newborns are extremely vulnerable as they are being born.

If someone makes a mistake when a child is being born, it can lead not only to devastating medical, emotional and financial consequences, but it can also lead to a complicated legal situation should the parents decide to pursue a claim for medical malpractice. Below is a look at some common injuries that occur and the potentially negligent parties involved in a preventable birth injury.

Common Birth Injuries

Generally, most preventable birth injuries occur as the infant is being brought out of the room. During any birth, there is a short amount of time when the infant is vulnerable because he or she is traversing the birth canal and is temporarily cut off from the oxygen supply that is so critical during those first few moments. Some of the injuries that can occur include:

Erb’s Palsy
Hypoxic encephalopathy
Cerebral Palsy
Muscle injury

These injuries can occur due to improper suction, improper extraction whereby the infant is stuck in the birth canal for too long and improper handling where the infant’s body is harmed due to the application of too much force in a sensitive area.

Parties Who Could be Responsible

When people think of medical malpractice and specifically birth injuries, most would assume that any mistake that leads to such injuries is the fault of the doctor. While it’s quite common for the doctor to be responsible, several other medical professionals are involved in the birthing process and each could make a mistake that causes damage to the infant. A few examples appear below:

Doctor – The doctor is in charge of the procedure, and ultimately accountability falls to him or her for a mistake during the birthing process.
Nurse – Nurses are always present in the delivery room and are trusted to handle critical aspects of the birthing process.
Physician’s Assistant – The PA is also present and deeply involved in the birthing process, and his or her mistake could lead to a mistake by the doctor in charge.

As you see, the decision of which party to target for the birth injury could involve a complicated investigation within the legal realm of discovery. If your child suffered a preventable birth injury in Arizona, you will need the help of an experienced attorney to make sure that you find out what went wrong and who is responsible. Contact Phillips & Associates today to schedule a free initial consultation to get the process of enforcing your rights started.

When finding an obstetrician or midwife, a mother will often look for someone whose views on childbirth are similar to her own. For example, should it be natural? At home? In the hospital? There are a multitude of things to consider when planning for the birth of your precious child.

Even when you are not planning on a pregnancy, it can be important to have an idea of what you will want in your future obstetrician or midwife. Since many women tend to go to a doctor who is both a gynecologist and obstetrician, they will have already formed a bond with the doctor before even thinking about getting pregnant. If you feel strongly that drugs are absolutely out of the question, find a doctor who will not pressure you into changing your mind even during your labor pains.

The first thing to think about is where you will want your baby to be born. Of course, this is not always a predictable event. Sometimes, no matter where you plan for child’s birth to happen, the baby might be in a hurry and arrive in the car in route to your chosen location. However, have a plan set ahead of time.

The typical place for a birth is the hospital. Talk to your doctor about what hospitals he likes, and pick one that is convenient for you. It can be a good idea to talk to other moms about the service of the nurses and other support staff at various hospitals around you. Some hospitals offer other options rather than bed births or caesarean sections, such as birthing stools or pools dedicated to water births.

If you will want to have your baby in the comforts of your own home, find a midwife who is supportive of your decision and available during the time when your baby is due. She might have certain requirements, such as handy hot water, that you should consider. Although increasingly popular, home births do carry some risk-sometimes, your newborn baby might need immediate medical care only available at a hospital.

After you choose where your baby will be born, think about the multitude of drugs available to mothers in labor. In a hospital, you can get an epidural or Demerol to help numb the pain of childbirth. Some mothers may not want drugs at all, and opt for “natural” childbirth. Obviously, you can have a natural birth anywhere, but epidurals and Demerol might only be available in a hospital.

Although you cannot predict the birth of your child with 100% certainty, having a birth plan in place can help prepare you and your medical staff for welcoming your child. Make sure to let your doctor or midwife know of your birth plans ahead of time, so they can plan accordingly.

If your doctor or midwife fails to follow the birth plan and causes an injury to your baby, this might count as medical malpractice. For more information on birth injuries in the Philadelphia area, check out the law firm of Lowenthal & Abrams, PC

Most parents or parents-to-be are so excited for the coming of a new member of their family. Even before the baby comes to the world, the parents see to it that everything is alright and that they have a welcome place to come home to. However, you also have to know what to do if your baby was injured during birth.

A baby always gives joy to a home and the baby’s parents want nothing but the best for their baby. But if this kind of accident happens, it is definitely not going to be a pleasant situation. You went all through the risky labor only to find out that your baby got injured after you gave birth. It is not a nice surprise for a mother.

What is more annoying is when the injury happened to a baby is due to the carelessness of the doctors and nurses whom you entrusted your life as well as your baby’s. A baby’s body is especially designed to survive the moment it comes out of the mother’s womb. Therefore, some cases of severe injuries in baby upon giving birth are due to the doctor’s mistakes.

If this happens to your baby, you have to immediately look for a lawyer specializing in birth injury grievances. It is important to act as fast as you could while your baby’s condition is still new. That will serve as strong evidence. If you are able to do this, you have a great chance of claiming a favorable outcome.

You know that injuries encountered by your baby is not just heavy for you to bear but also gives your baby’s delicate body an early suffering. Not only that, the kind of medical treatment that your baby has to undergo can be extremely costly, but essential to them having the best life possible.

There are different causes of birth injury. Some of them may due to wrong medication given to the baby’s mother, miscalculation of the right measurement for the baby, or even poor use of medical instruments. Most of the time, the baby is lucky if treated after a few months. But what is not good is when the baby has to grow up with disability due to a birth injury.

To give you and your baby the best hope at an early stage, it is a wise move to contact for a medical malpractices lawyer. Looking for a good lawyer may not be that easy and the ads seen somewhere may not be reliable. You have to check for a reputable directory for you to find a better one. You can either check in your own locality or near the place where you gave birth.

This is the best thing to do if your baby gets injured during birth. As early as possible, you can settle your claim and your baby can have the early and necessary medical attention that he or she needs.

Erb’s Palsy is a type of paralysis occurring in the upper arm due to nerve damage. The damage done to these nerves almost always takes place during childbirth-typically, during births that are abnormal or notably difficult. Excessive strain on the neck and head of the baby, or pulling on the baby during childbirth is the most common causes of this paralysis. The extent of nerve damage can vary greatly from child to child, and so can the treatment options. In some cases, the damage is minimal enough that it can heal on its own, and in other cases, a child will require physical therapy or surgery.

In children who are not able to regain range of motion on their own or through physical therapy sessions, the most common treatment options are:

· Nerve transfers

· Sub Scapularis releases

· Latissimus Dorsi Tendon Transfers

Nerve Transfers

In a nerve transfer operation, nerves are taken from the leg of the child opposite the affected arm. Typically, this procedure is only performed on children who are under 9 months old. The ability for children’s bodies to heal themselves after a procedure is greatest in this age range, and while there can be success rates for children older than 9 months, in many cases the harm brought upon the child through this procedure is greater than the benefits they receive.

Sub Scapularis releases

Sub Scapularis releases are not limited by the age of the child. In this procedure, a “z” shape is cut into the Sub Scapularis muscle of the affected arm, releasing the tension built up in that area and increasing range of motion for the child. This procedure can be performed repeatedly, as often as needed by the child, but multiple procedures do run the risk of causing permanent damage to the muscle.

Latissimus Dorsi Tendon transfers

In a Latissimus Dorsi tendon transfer, the Latissimus Dorsi is cut in half, so that part of the muscle can be pulled out and stretched to wrap around the bicep of the individual. While this can often be a very effective way of restoring motion to the arm, it can cause added sensitivity to the bicep, as the Latissimus Dorsi has more nerve endings than other muscles in the body.

While these procedures are often times successful in restoring movement to the affected arm, there are side effects to be aware of. In some cases, patients who previously had full sensory perception will experience loss of sensory perception following a procedure.

Cerebral palsy is a group of disorders that usually affect the motor function of the person who has it. Cerebral palsy is not a progressive disease, meaning that the symptoms do not get either worse or better with time. Cerebral palsy usually affects either one or both of the arms and legs, though it seems to be a disorder related to brain injuries.

The exact cause of cerebral palsy is often difficult to pin down but has been directly linked to some injury to the brain or nerves before, during, or shortly after birth. Cerebral palsy can also occur from injuries or diseases sustained in early childhood, usually in the first two years of life.

Cerebral palsy can range in severity from just a slight arm or leg problem to very serious cerebral palsy, which can lead to complete immobility and a paralysis of several organs and limbs. Speech, eating, and learning impediments can also accompany cerebral palsy. The symptoms stay the same throughout the cerebral palsy sufferer’s life.

Cerebral palsy is a very common disorder that seems to be becoming more prevalent. Since cerebral palsy is often not diagnosed until a child is two years old, if the disorder is a mild case especially, then numbers are often not reported in a timely fashion. Over 500,000 people in the US have the disorder.

Three main kinds of cerebral palsy include spastic CP, athetoid CP, and ataxic CP. Some cases of cerebral palsy have one or more of these three types. Spastic CP’s symptoms include a muscle stiffness that may make reaching or walking difficult. Athetoid CP results in some off-balance walking and also muscle tics. Ataxic CP symptoms include balance disorder and some difficulty in perceiving depth around them.

Cerebral palsy is a kind of movement disorder and as such is not curable. Treatment for cerebral palsy includes many types of therapies that can help the symptoms of cerebral palsy, however. Several kinds of surgeries have also proved effective in helping the cerebral palsy sufferer walk and reach again. Other types of external equipment such as computers, wheelchairs, drugs, alternative healing methods, massage, and others are becoming widely accepted worldwide due to their alleviation of cerebral palsy symptoms. Advancements in new technologies and medical treatments make the future look better for many who suffer from cerebral palsy.
